This Prohibited & Restricted Items Policy (“Policy”) governs all listings, services, and user activity on Gaubazar, operated by VisionX Enterprise Pvt. Ltd. By accessing or using the platform, users agree to comply fully with this Policy and all applicable laws of Nepal.
⚖️ 1. Legal Status & Governing Framework
Gaubazar operates as an intermediary service provider under the
Electronic Transactions Act 2063.
This Policy is aligned with applicable Nepalese laws, including:
- Muluki Aparadh Sanhita 2074
- Drugs Act 2035
- Narcotic Drugs Control Act 2033
- National Parks and Wildlife Conservation Act 2029
- Ancient Monuments Preservation Act 2013
- Foreign Employment Act 2064
Gaubazar enforces a zero-tolerance policy for violations of these frameworks.
🛡️ 2. Platform Role & Liability Protection
- Gaubazar acts solely as a digital intermediary marketplace
- It does not own, verify, or guarantee any listing
- Under Section 69 of the Electronic Transactions Act 2063, Gaubazar is not liable for third-party content if action is taken upon notification
⚠️ Use-at-Own-Risk
All transactions are conducted at the user’s own risk. Gaubazar provides no warranties regarding legality, authenticity, or safety.
2.1 Voluntary Moderation (Good Samaritan Clause)
Gaubazar may review or moderate content to improve safety. However:
- This does not create legal responsibility
- It does not imply full monitoring
- Failure to detect or remove content does not create liability
⚖️ 3. Absolute Enforcement & Interpretation Authority
Gaubazar reserves the sole and absolute discretion to:
- Determine, interpret, and enforce this Policy
- Remove, restrict, or modify listings without prior notice
- Classify any item or service as prohibited, even if not explicitly listed
🚫 4. Strictly Prohibited Categories
🏥 4.1 Pharmaceuticals & Health Products
- Prescription medicines without valid authorization
- Unapproved supplements not approved by the Department of Drug Administration
- Medical or clinical equipment sold without licensing
🐅 4.2 Wildlife & Natural Resources
- Protected animals or derivatives
- Endangered species trade
- Restricted forest products without permits
Regulated under the National Parks and Wildlife Conservation Act 2029.
🏺 4.3 Antiquities & Cultural Heritage
- Items exceeding 100 years of age
- Religious or historical artifacts
- Archaeological coins, manuscripts, or relics
Governed by the Ancient Monuments Preservation Act 2013.
💀 4.4 Weapons, Narcotics & Hazardous Materials
- Firearms, ammunition, explosives, and weaponized tools
- Narcotics and controlled substances
- Hazardous chemicals, toxic materials, and industrial waste
🆔 4.5 Identity, Financial & Digital Assets
- Government-issued IDs (citizenship, passport, license)
- Banking tools, SIM cards, e-wallet credentials
- OTP trading, hacked accounts, unauthorized access
4.5.1 Virtual Assets (NRB Compliance)
In accordance with directives of the
Nepal Rastra Bank:
- Cryptocurrency (Bitcoin, USDT, and similar assets) is strictly prohibited
- Crypto trading, mining, or promotional content is not allowed
- Network marketing (MLM), pyramid schemes, and unlicensed digital wallets are banned
🔞 4.6 Offensive & Harmful Content
- Pornographic or sexually exploitative material
- Any content involving minors (zero tolerance)
- Hate speech or discriminatory content
👟 4.7 Counterfeit, Fraud & Piracy
- Fake or replica branded goods
- Pirated software, media, or digital products
- Fraudulent, misleading, or deceptive listings
💼 4.8 Restricted & Illegal Services
- Foreign employment listings without valid licensing from the
Department of Foreign Employment
FEIMS Requirement
Listings must include a valid Lot Number and be verifiable.
Financial Services Restriction
- Unlicensed loan offers or “Dhukuti” groups
- Unauthorized gold/silver trading
- Unregulated investment or financial schemes
👤 5. User Responsibility & Legal Liability
- Users are solely responsible for their content
- Users must comply with all Nepal laws
- Violations may result in civil and/or criminal prosecution
Gaubazar reserves the right to report users to authorities without prior notice.
🚨 6. Enforcement & Compliance Actions
- Immediate listing removal
- Account suspension or permanent ban
- Device-level blocking
- Referral to Nepal Police Cyber Bureau
6.1 Metadata Preservation
In accordance with the
Electronic Transactions Act 2063:
- Server logs, IP addresses, and user metadata are securely stored
- Data may be shared with law enforcement for investigations
🔐 7. Platform Security & Monitoring
Gaubazar may implement:
- AI-based content filtering systems
- IP tracking and device fingerprinting
- Fraud detection and behavioral monitoring
🌐 8. Jurisdiction & Governing Law
This Policy shall be governed by the laws of Nepal.
Any disputes shall fall under the jurisdiction of
Kathmandu.
8.1 Language of Interpretation
- This Policy is written in English for accessibility
- Legal interpretation shall follow Nepalese law
- In case of conflict, Nepali legal meaning shall prevail

Continued use of Gaubazar constitutes acceptance.
